I am in the process of appealing against my Incapacity Benefit being stopped. I filled in the approved form, saying exactly why I am doing this, and sent the benefits people, promptly and as requested, a sick note. The sick note was accompanied by a letter which basically said 'This is the sick note you asked for'.
Last Friday (two working days ago), I received two letters demanding a sick note, one worded slightly differently is all. Today, I received a letter enclosing my sick note, with my little accompanying letter, returned because the letter was not signed! The attached sick note had my signature. All the information needed to process the sick note, was on the sick note, the little letter was in truth superfluous.
Looks like I have a true blue bureaucratic battle on my hands......me and thousands of others in a similar position. If I complain it'll only slow things down further. But I'm keeping all the evidence of inefficiency and bloody minded bureaucracy until my appeal has been heard.
Initial the correction, then initial the initial and initial the etc....

Good luck, I am still fending off the Council Tax office snowstorm of letters about their overpayment of 4 x 50p when I was off sick. I had five letters in one post last week! |

I have appealed against my ESA being stopped but lost the appeal!.
A year last july i had an accident and broke my back, i can no longer work full time but do have a part time job and with ESA was coping paying bills etc. I also had a sick note, which they ignored, i have also tried for DLA and was denied this as well. Now have a specilist appt and will know more then.
If you get a letter saying do you want to attend the tribunal or appeal by post apparently its better to go in person as more are denied by post. Try the CAB for advice and be very careful what you write. Lay it on thick and fill in the results as if every day is like one of your worst.
