Immoral Tenancy Agreement. (85)

Just been having a look at a friend's tenancy agreement. It's a pretty standard form but some of it is pretty alarming....for instance, " The tenant will not: do anything at the property which is illegal or immoral or is a nuisance or annoyance to the landlord" Pretty open ended you will agree,but what got to me was the mention of immoral.By whose standards ? Who says what is and isn't immoral ? By some people's standards I am a pretty immoral type myself (shan't go into details) what hope for us wierdos in this straight world is there? Its getting worse !

It's a fairly common clause in agreements now days to avoid things like drug dealing and brothels being run, means the landlord can evict without warning really (ok there is more to it than that but I am summarising). If your friend is worried then get them to keep most things out of sight and not to worry too much, landlords are meant to give notice when they want to inspect property, which is often enough time to boot the kit box back under the bed.

As for what is and what isn't immoral, well that is definitely open to interpretation, I suppose it depends if the landlord is a highly religious person or a kinkster like us!

Fairly standard, I understand.

Working girls, Pro-dommes, etc. always used to have to either pay an exhorbitant rent to someone prepared to take the risk of being done for allowing their property to be used for immoral purposes, or expect to move on once someone tipped off the landlord ... or sometimes pay the exhorbitant rent and still have to move when the pressure put off customers.

We exchanged knowing smiles when my landlords read out the same clause in my tenancy agreement.

Mind you, the previous tenant had a pole dancing pole set up in the dining room so I would like to think that my landlords are fairly open-minded!

You never know how strong you are, until being strong is the only choice you have.

Immoral is a standard phrase and also occurs in my leasehold agreement which is more than 20 years old. Basically if refers to prostitution, bawdy houses, etc.

The 'illegal' bit may stem from previous police practices of prosecuting landlords if drugs were used or found on their premises. It happened a few times back in the 1970s but there was such an outcry that prosecution of landlords ceased unless it could be proved that they knew about the drugs.

Another standard ban in tenancies, leaseholds and title deeds is preventing the housing or working of 'noxious substances' which was invented to prevent anyone from the leather tanning industry setting up work. These days it has a wider and more environmental meaning. I recently invoked the noxious substances part of a title deed to prevent people using a private driveway as a dogs' toilet. It worked!

I suspect you think immoral means 'naughty'?
