My question was....why would he be jailed if they were two homosexual men but not if it were a man and woman? I know the Spanner case, but I don't see anything there that says it only applies to gay men... So..have I missed something important? (and why I think LAB was being facetious)

The Spanner case was obviously biased against the men because they were gay. This was further confirmed by the case just a few years later about the married couple, where the man was let off after branding his wife's buttocks. BDSM between gay men was torture and the public needed to have their morals protected but BDSM between a married couple was their own business and nothing to do with the court. These cases seem to show that hetero BDSM is okay but gay BDSM is illegal.

Yes that is true and status que has not changed since then but I never heard of a transgender BDSM case involving such acts,unless has been one and it has been covered up?

hmmm...or the "partner" scenario. I wonder if it would have still turned out the same if the participants in the branding case had been gay civil partners...
