Unfortunately, rather like Holland's original legal representation, many duty solicitors just aren't up to speed. Very likely both. Backlash is currently trying to find out.
This, sadly is what it boils down to. Backlash gets a few calls for help before cases go to court, and those people are being advised properly. But most turn to the duty solicitor, where this reaction is common, as in the case of Damien Wentworth - http://www.edp24.co.uk/content/edp24/news/story.... Solicitor Richard Mann said that Wentworth had received the image several years ago: "Technically, he is guilty of the offence, but I would say that he didn't even know it was an offence to have this on his phone.” "I can't blame him for that, as I didn't know that either, and nor did the solicitors I have spoken to in court today". Parliament is due back from recess in a few weeks and it's essential that we push for repeal of this law. Backlash has been working on this action since the introduction of the new coalition government, and in the meantime, ignorance of this law, will continue to more thought criminals being created. Providing legal support is time consuming and certainly isn't cheap, and Backlash kindly requests donations so we can continue to provide support for those people who come to us for help.
