As far as I'm aware, there would be two types of cause you could in theory raise and neither of them have anything to do with the person being a limited company or vat registered. You may try and claim under contract law - which in Scotland is almost entirely common law - as you have a verbal contract of service, however if the activity is of an illegal nature then you've formed a pacta illicita and you cannot found a claim upon that. The other route does not require a contract and is a claim for damages - delict in Scotland, and again common law. Although you'd have to prove things like relevance, a causal relationship between the act and an injury and then you'd get told that you were contributory in the event anyway, i.e. you share the blame because you went there in full knowledge. This is the generalised version of what bohnanza referenced as duty of care. If someone on this thread is actually a practising solicitor, please feel free to correct me. And the flip side of what I'd previously said is you could potentially sue under contract for not having been injured, e.g. if you'd agreed beforehand that your rear end should be a nice rosy shade of red afterward and it it wasn't. Although I suspect there may be an overriding implied clause that whatever the pro-domme says goes, so anything else wouldn't really be actionable. Auch, it's a mine field I dare say.
