Prosecuted under the 'Trades desciption act when they' Advertise services and cannot provide you with relevant documentation of being a registered company nor have a VAT number to allow a return claim for leisure activities? If you visit one of these pro-dommes who is not a registered company for tax purposes, nor is VAT registered, then you may have no way of a common law recompense for any injury sustained during said activities. So be careful out there when your playing what say you ? | ||

There's no obligation for any individual running a business to be a limited company. They can operate as a sole trader if they prefer. There's also no obligation for them to be VAT registered if their turnover is below the VAT threshold (£57k/year last time I checked). That is of course completely wrong. As said above by, PapaSMurf, you can be a sole trader or a partnership and be below the VAT registration threshold. Liability for injury has nothing to do with someone's trading status, it has everything to do with a Duty of Care. You would start a court action based on their lack of Duty of Care, rather than their VAT number. Why don't cash machines have a Gamble button? | ||

VAT liability is incurred as a result of gross income not net. At an average charge of £150 per hour most Pro Dommes will become liable to pay VAT if they work 380 or more hours a year. That equates to just over seven hours a week. S.x.

As we are on to kinky accounting ii have a question... If a Pro-Dom is paying vat, can they clame vat back on equipment and expences, like fuel and van hire for kidnap scenes? Also if a sub buys gifts for a pro-Dom, can they or the Dom clame the vat back? There is no room for development in this thread as far as I see. You've asked if people should be prosecuted under the trade descriptions act for satisfying the criteria of a perfectly legitimate sole trader. Also like everyone else is saying, personal liability has nothing to do with VAT numbers. If I try and extrapolate your original post out a bit, are you concerned that you wont be able to bring legal action against Dommes if they cause injury?
