Poor bloke has been waiting to get this sorted for ages - he first made as complaint in 2003! Not heard any news if it was successful. If anyone comes across any I'd be interested to know.

I found this but no evidence that it's actually been heard as this from a brief glance simply sets out the argument.

I understand a similar situation obtains in the UK if you need a security vetting for a job- eg, to work with children. Any allegations even rumour, of 'incorrect' sexual behaviour can be considered as being 'against' you, and you have no right of appeal.

I love the comment by the policeman, 'Why are you wearing black?' He was wearing a black suit, is this not quite common?

From what I understand over in Canada the expert witness that has testified (Charles Moser) an expert in sexual minorities and SM. He is of the view that sexual orientation law applies.

Actually, I too would be interested in the final outcome, as i cited this case in something i wrote a couple of months back - and like you, i wondered at the outcome.

This is Purple Crow (my real name) of the VPD/HRT court case in Vancouver BC Canada.

My lawyer, Lindsay, says "We could be notified any day now, but as you know it's been a while since our estimated spring 2010 decision date.", which she has been stating since this recent spring. Like everyone else, we shall have maybe 24 hours notification of any impending posted decision on the HRT (BC Canada) website. Until they post their final decision we are as "in the dark" about this entire ride as everyone else is.

Until such time as a decision is made I continue to reflect on occasion upon human nature on every level. It's been an absolutely ridiculous ride through other people's dramas, needless fears, profit margins, quotas, utter ignorance, inability to do a proper investigation (even when openly invited to do so) and paranoid phobias and conspiracy theories... with a few select positive defenders along side our campaign for truth regarding human nature and sexual freedom.

Personal sovereignty must remain absolute in any "free country" and assorted systems must continue to dispel senseless fears and help assure the free in said countries to be able to continue to live freely without unjustified paranoias and fearmongering. (The internet is bad enough, thanks, it should not also be forced into the work-place from outside forces) If said systems fail to help protect freedom of expression respectfully presented, then the choice is clear - they are to be re-written after some struggle to kick them out. All the best countries on this planet go through regular upheavals as required by the citizens of each region to assure the people of these regions that they can live free of oppression while remaining respectful of other people's individuality (whether chosen or by birth nature). Those countries and/or regions that fail to do so deserve exactly what they complacently allow to transpire, right in their own bedrooms with those they are most intimate and trusting with, where it all eventually leads.

Being hired by a private company (where even asking "Are you Pagan?" or "What is your sexuality all about?" can land them in court - which did not happen) and then being told by a police force that does not want to investigate anything what so ever, even by invite to do so, to meet friends and other club members in person, that they have the "right to interfere" in consenting adult choices to hire or be hired by whoever they wish, is fascism, plain and simple. NO GOVERNMENT who fails to come meet the very people they are discriminating against has ANY right to tell other people who they should or should not have sex with and thus sabotaging their career.

The conspiracy theory they used against me in court was based on ONE complaint (uninvestigated, one sentence long internal memo) from a year previous, with no charges being laid, no investigation being planned, and was based on one unmedicated jealous female who was REFUSED partnership with me and became a stalker - which explains why they didn't take her that seriously in the first place. However such "checks" are still recorded for "future reference" within the VPD and was then used against me as "evidence" in an attempt to thwart my constantly growing popularity as a freelance investigative journalist (1987-2005) who has also delved into police corruption that some would say is "quite Satanic in nature" (IE: Dark, corrupt, murderous). Being public and "unowned" by main-stream media about such reporting has targeted me many times in the past and this latest attack came as no surprise to me. The VPD tried to also claim that anyone who researches UFO reports is "nutty" and therefor loses all credibility... until I presented the court with their OWN DOCUMENTS on this very research as recently declassified and publicly available on another government website. As it turns out their own documents state the desire to oppress and even publicly discredit people who report UFO sightings. I thus proved that the VPD has a "license to lie, not just kill", thus terminating their credibility instantly using their own words. I've gotten rather good at that over my many years in that particular field of investigation. Their tactics had to change a few times during the several days long hearing a few years ago.

Other "evidence" based on these "checks" attempted to be used against me was "being caught walking a female on a leash downtown during a festival". (This comes from the city with one of the largest gay pride parades in North America) You can see how easily their fascist attacks soon appear rather blatant, malicious and personal once the entire story is told as witnessed and recorded in the court system. My ex-slave has testified against the VPD for this attack and others, as did friends and "suspected cult members" of my coven (former members included). Even a military officer (who sent our troops off to Afghanistan) testified in my defense - he is a licensed Pagan priest and 24'7 lifestyler himself.

If we "lose" this case, I hope for a MASSIVE REVOLUTION to continue to grow exponentially against corruption such as this on every level, partly because many politicians, police and military personnel we already see at assorted BDSM clubs in Vancouver and elsewhere, even if masked much of the time for fear of losing their jobs. Lifestylers and kinsters are everywhere and are encouraged by many sex therapists world wide. There's NOTHING wrong with sexuality whether one is born that way or simply chooses to explore their bodies and the bodies of others consensually.

I am one who chooses not to fear my own government - there really should be no need to do so. I pay taxes, I vote for them, thus they work for me, and I am their employer. If they no longer protect freedom of expression then they no longer work for me because they no longer represent me and thus should be removed from their position. This entire court case proves that fact and the incredible support that we have received also backs that us up. Having three signatures from three female supreme court justices in support of a revolutionary re-writing of Human rights and freedoms in support of BDSM lifestylers being respected as "a valid birthright", and noting that they "vetoed" the VPD's little patriarchal clique brought a smile to my face as I saw honour in their choice to "see this case through", no matter the outcome. I am a male Dominant, but I highly respect all genders, honour and courage of all kinds. Their choice to push my case through and stop the VPD from taking away my right to a fair trial says it all and kept my hopes up that perhaps parts of the system does indeed work.

If we "win" this case, great changes will be marked down in history in Canada and shall be noted across the globe, however, considering the greater picture of what's actually taking place, and I have 23 years of freelance investigative journalism under my belt on this and other far more cutting edge subject matters, it shall merely mark a small portion of my contribution towards freedom, true freedom, for everyone on this planet. I did it because IT MUST BE DONE. It's not about me... it's about EVERYONE. If I end up being the first person to actually do this, fine by me. I do not fear failure OR success. Opinions shall exist in all countries, on all levels, and shall forever remain free to speak their assorted levels of self-awareness and ignorance every step of the way. it's all part of being human while studying one's own people and one's self throughout one's lifetime. I defend the rights of those who speak out against what I have done, but I also point out their ignorance equally so. They are not me - they are themselves. Officer Barker looked into my eyes as I did his, no one else was present (as far as I could tell anyway). The truth is what already took place between us. The rest is his "personal army" within the system itself against my "hired help". I know the man's honour or lack thereof personally, directly, and I can pass a lie detector to that fact where I know Barker would fail. That, to me, is success from the very beginning and is its own reward. The rest of this activity is just the best humans have come up with so far as to how to deal with everyone else who was not there at the time - a simple game of chess played by PAID actors. I am neither impressed nor disappointed by anyone involved. I am already myself and shall remain true to the very end and I defend the rights of others to do the exact same - everything else is moot in the greater picture - but in the words of Gandhi "Whatever you do is insignificant... but it is still very important that you do it."

I am open to private e-mail but assure you I get plenty already and am starting up a new corporation to help get Canada out of the oil wars in other countries through Cellulosic Ethanol extracted from Hemp plants, so I am VERY busy and cannot possibly respond to everyone, although I equally assure you that the letters of support are most delightful and inspiring. Keep up your efforts as I never lose sight of my own. Stay strong and true to yourselves while respecting those you both agree and disagree with - that is of the utmost importance. :>
