Hiya Lovely Folks Im right in the meat of building a kinky website and want to know the clear cut LAW and general responsibility of such a site to have an 18 yr or older Enter or Leave Disclaimer page. Darnit tho the database has already been installed and its a blogger site so such a page isnt possible without re-installing the whole thing and starting from scratch-which we are willing to do of course. Is it possible to have a modest looking homepage and *WARN/ASK peeps who may be offended or are underage to TURN AROUND and please GO AWAY instead??

The site revolves around spanking so there wont be any extreme images except for some red bottoms-which of course many may find offensive. I think we might just go for a static homepage with a leave button to direct people elsewhere.

Thank you in advance for constructive and genuine advice from anyone who is honestly in the know. I would prefer to steer clear from a *debate on this thread if possible and stick to the task at hand as this is time sensitive-Thanks and SPANKS!

The most constructive suggestion I can think of is that you actually invest in getting a genuine legal opinion from whichever firm of lawyers normally advise your business (at least, I assume from your post that you're a business).

Apart from the obvious fact that any casual opinions you gather here will be contradictory (and therefore half of them are guaranteed to be wrong :-)), what's it going to look like later on if you're challenged, and your response is "well, this bloke I've never actually met told me....."?

Painful as it is, there are times when one simply has to bite the bullet and pay a lawyer!

After searching round Google it looks as though there aren't any legal requirements as such, but whatever you do do doesn't mean you have absolved all responsibility. It depends on your content and whether it constitutes porn or not. A tame Home page with a warning is pretty much what most of us do. It's the pay sites who can do a better job because usually you can't see too much without a credit card.

From some legal advice I once recieved, a disclaimer can be totally discounted to have no effect. It helped me win a case against a company.

I agree you should seek qualified legal advice but bear in mind disclaimers are not 'Get out of jail free' cards.

Rather than starting from scratch with what you've already done, would it not be possible to have a seperate homepage with an enter or leave redirect and have the enter button direct you to your current hompage as is?

I know i've surfed a few sites using bookmarks to the homepage which don't allow you to get to the homepage unless you're directed from the disclaimer page, when you try to enter the homepage from a bookmark it redirects you to the disclaimer.

Not sure how easy or hard that is but it might be simpler than a whole re design:-)

I suspect that not only can such disclaimers or notices be disregarded by any visitor, the mere presence of such a notice may be held to indicate that the content of the site was known or believed to be objectionable or even obscene.

Keepers or owners of dangerous dogs sometimes put up a sign on their garden gate telling people to beware of the dog or even that trespassers will be eaten - and such signs have been used to indicate that the dog's nature was such that it would bite people without provocation.

You can get straight in without any conditions page if you go via Google.

That is an older website, not the one i made, mine is http://www.mistresscharlene.co.uk and you clicked on Google search result which was http://www.icedomain.co.uk/TMM/home.html this is the older one made some time ago from someone else.

I am currently making another new one which can be found here http://mistresscharlene.com although this is not finished yet :)
