It was the CPS trying it on, all along.

ETA This was the first day of the trial which was scheduled to last all week, so that's either the prosecution stopping and thinking for a minute, or the judge throwing it out.

Excellent news!

His defence argued that the article was not accessible, and could only be found by those looking for specific material.
A key part of the OPA is that it must deprave and corrupt those likely to see it.

Something worth remembering when we hear the claptrap about the "extreme porn" law only criminalising images illegal under the OPA - as the new law has no such test.

ETA - glad to see some good arguments in the defence:

However, a report for the defence by an information technology expert said that it could only be discovered by internet users seeking such specific material.

A report from a consultant psychiatrist also said it was "baseless" to suggest that reading such material could turn other people into sexual predators.

Again though, none of these defences would strictly defend against the "extreme porn" law, which simply asks the jury if they think the images are "disgusting".

Not all good news though, for him:

The courts also heard that Mr Walker had lost his job since his arrest.
And it's unclear whether he'll even get it back, despite being found not guilty. There is no help for the one person who is actually harmed by all of this.

Sign the statement against criminalisation of possession "extreme" images. Petition against plans to criminalise sexual cartoons appearing to depict anyone under 18.

Great news!

Well done the psychiatrist too.

Who are these spooky sounding people also? ' the Internet Watch Foundation.'

Not too great though as he lost his job over all this and has had the worry hanging over him since early 2008.I wonder if he can claim damages?

... an argument which is an Obscene Publications Act killer, since the OPA requires the material is likely to "deprave and corrupt". If the CPS pulled out, then I wonder if they were worried about the case hinging on that and it turning into a precedent?

Good news. It was a joke prosecution - I hope the police and CPS are sued for harassment.

A report from a consultant psychiatrist also said it was "baseless" to suggest that reading such material could turn other people into sexual predators.

If the jury accepted this - doesn't that rather nullify the OPA?

As for the IWF, they are government approved and funded but are technically a non-governmental organization (a charity, in fact). They have no accountability whatsoever yet because of the blacklist all but forced upon most ISPs they have the power to censor the internet for 9 out of 10 users (without users knowing it is being censored, attempting to access a blacklisted site simply returns a technical error message) who have no recourse to the courts or to the voting booth.

What men in all the world have shown such daring?

It says "reading such", so the argument may have just been made regarding that specific material, and not all material. Or even if it was a general argument, "reading" won't apply to looking at images, which is what the OPA is usually used for :)

In practice, I hope this puts off prosecutions for written material for a while - but the police keep trying every ten years or so, and I just wish the law would be scrapped. (With this Government though, I fear the only chances it'll be scrapped will be if it's replaced with something more likely to get prosecutions...)
