Activists with kinky porn target Chiefs of Police.
A delegation people involved in the Consenting Adult Action Network (CAAN), will be taking their extreme pornography advice seeking to ACPO, the Association of Chief Police Officers, today in London. CAAN will be demanding that a collection of evidence consisting of hundreds of kinky porn images is scrutinised by ACPO. CAAN want to know which images people can be arrested for owning in four months time when the CJIA takes effect, when millions of people will be able to get 3 years in jail for owning a consensually made image that they may not realise is illegal. CAAN are asserting that if those who outline the police's powers cannot answer their questions, they have no business commencing the criminalisation of the consenting adults who make and view kinky erotica.

BACKGROUND
CAAN has a growing collection of submissions from members of the public of extreme pornography which they need advice about. Nobody seems to know what is ok to possess and what is not. CAAN took the evidence to West Midlands police in June for advice but the police said they were waiting for ACPO to create their guidance and may only be notified of the implication of this change two weeks in advance of their powers being commenced. Beware the kinky porn ban!
New law makes criminals of consenting adults.
Police can enter your home to investigate your fantasies.
Up to 3 years in jail for owning a picture!
No-one should be arrested or put in jail for a crime that is so unclear that you need a lawyer to tell you whether you are committing it or not. But that is precisely the position that millions of people are likely to find themselves in from January 2009. The government has made it a criminal offence to own kinky porn or even look at it on your computer. So far, their definition of what might be criminal has stumped the lawyers we have asked.
We all need to know whether the books and images we own are legal, or not. So we're here today to raise awareness about the imminent kinky porn ban and to ask the authorities - who have just passed this new law - which pictures we could be arrested for owning. If they can't tell us, then we do not believe they have any right to be criminalizing consenting adults.
The story so far. On May 8th 2008, the government passed legislation criminalising the personal possession of 'extreme' pornography. Provisions 64 to 67 of the Criminal Justice and Immigration Act 2008 come into effect in January 2009. Convictions will carry up to 3 years' jail sentence and inclusion on the Sex Offender Register, even if the pictures are of your partner.
No evidence exists to prove that looking at these images causes people to become sex offenders, as the government has been suggesting. Viewing images is a poor excuse for those who commit real abuse to use in court to justify their actions. Why waste time and money policing the bedrooms of harmless adults?
What does extreme mean? Despite concessions from the government concerning some images of legal activities in which the owner can be proved to feature, this law will still criminalise fantasy images involving consensual acts between adults - whether or not the act was staged. They have said they will prosecute those who possess 'realistic' pictures that look like acts which threaten life such as strangulation or 'serious harm' to breasts, anus or genitals. Could this also mean sex without a condom, fisting, sex while smoking? It won't matter when you aquired the image, or where from.
