the world has truly truly gone mad.
we really need to get to work and create a collection of this kind of political amusing art to take to the police stations for advice. "does THIS meet the law officer???" and then swap photos with a mate who wasn't there. "and how about now???"
I think they'd thank us for wasting thier days looking at our inventive and amusing porn. far more fun than chasing bank robbers.

No you wouldn't - you only need a BBFC rating to sell or rent video within the UK.

(2) An “excluded image” is an image which forms part of a series of images contained in a recording of the whole or part of a classified work.
In this section—
“classified work” means (subject to subsection (8)) a video work in respect of which a classification certificate has been issued by a designated authority (whether before or after the commencement of this section);
“classification certificate” and “video work” have the same meanings as in the Video Recordings Act 1984 (c. 39);
“designated authority” means an authority which has been designated by the Secretary of State under section 4 of that Act.

The upshot is, images in your holiday films are not exempt unless you get a certificate.

If that were the case my existing holiday movies would be illegal as i've not sent them off to the BBFC.
According to Wiki "The Video Recordings Act 1984 is a UK Act of Parliament that was passed into law in 1984.
The act states that commercial video recordings offered for sale or for hire within the UK must carry a classification that has been agreed upon by an authority designated by the Home Office."
Then there's the obvious loophole that it can be sent from elsewhere in the EU without a BBFC rating.

Or other maybe commentators making jokes about what's going on, might make it not as fun to watch, but if it's obviously an attempt at humor that'd be a reasonable defence.

we really need a well known comedian onto this - the possibility for humour is endless, some of the ways this law is going to work out in reality are more appropriate for a circus than a court room. hopefully the CPS will realise!

So ideally they should include the aftermath of puffed up eye socket, bruised limbs, glaring cane marks, and drooling newly-pierced tongue to show it really is a post-scene survival shot - and it needs taking quickly before those transient and trifling marks fade

I wonder if the USC 2257 could be extended for BDSM material to include certification from a medical doctor to confirm that all the participants were 18+, consented, weren't under the influence of narcotics, weren't harmed or weren't in danger?
As an aside, I saw a program on Sky recently that showed various methods of "self defence" that showed in great deal how to inflict serious injury or death o people - funny old world eh?

You miss the point (by so much, it's a throw in at the half way line). You obviously don't need to get your holiday films approved. But if they contain, or you insert images into them, which are against the CJIA, then they are illegal to possess. The only exception would be the highly unlikely situation that you had your holiday film approved by the BBFC.

It must encompass lots of foreign made films which hae never even sought BBFC certification...

Yes it does, if they contain extreme and pornographic images as defined.
I'm not sure about films which have received a certificate from another Europoean censor though - there may be a pan-European agreement which says that provided one country's censor has approved it, then the film can be distributed in all other EU countries.

Now I do know my stuff on this bit!
There's no pan European agreement on film classification, and not surprisingly the UK is one of the strictest when it comes to censorship. Personally I tend to buy all my DVD's from abroad, even non-adult ones. With a UK version you can never be sure it's be cut down to protect us. Even if the BBFC don't censor it, the film distributr's know what's likely to be censored and remove it before sending to the BBFC.
Also your free to personally import material from elsewhere with the EU.
This leads to some bizarre anamolies. For example it's illegal for a UK sex shop to sell an R18 DVD by post, yet if you order the same video from Holland it can be mailed to the UK and nobody has broken any laws!
