I believe MPs will still be able to smoke in their bar at the House of Commons. The bar is exempt the ban as the building is still apparently a palace, so Auntie Liz could move in and the ban doesn't count for residences. If someone moves into a club, maybe they can call it their home and everyone can still puff away? All hail Zoidberg, saviour of the Universe! | ||

That will depend how much your council waste on policing it. Aren't there more important things to police? Then again it could be another great revenue raiser. That's interesting, I thought the law applied to any place of employment, hence it's applicability to a private members' club would depend on if you employed staff. The only private club I have been a member of is a local snooker club. They had paid bar staff hence I would expect the new law to apply. That is not the same as a typical home party, where you will not normally have any such staff. What have I misunderstood? | ||

The law most definitely applies to private members' clubs, though there was a big debate about it at the time. If I recall, the legislation was originally going to exclude them but was amended. Personally, and selfishly, I'll be happy to see the ban come in. I don't smoke and it'll be nice to come back from a fetish club without my clothes and hair stinking of cigarette smoke! | ||

I think for the sake of other people it would be terrific and very kind of you if you didnt smoke in the prescence of others. Not everyone enjoys secondary smoking.

The points to remember are theoretically a member of a private club ''that is one which is secured through a limited company which is guaranteed by nominee ''
this means any member joining is a shareholder in one share which does not pay an annual dividend and has a assets in the club therefore they are shareholders in the premises not ''the public'' not a ''visitor'' not an ''employee'' it should be up to the members of this club to vote in the proper constitutional manner whether they want the smoking ban or not however just to muddy the waters there could be all sorts of legal problems for instance if someone thought their health was damaged by attending the club the committee (which is in fact the managing directors of the limited company that control the club) may be liable under corporate negligence laws and even insurance policies for fire may be invalidated in fact is a whole nest of worms however I still disagree with smoking within clubs I still feel it is a breach of human rights to impose on a private members club such laws if you don't like the rules controlling a club don't become a member and remember just because somebody makes a law it can be challenged you may find somebody quote the Human Rights Act and a court will not be able to hear the case under British law and if it's heard under European law the outcome may be somewhat different just because somebody passes a law it doesn't mean to say it is enforceable loads of people lose their bikes every week and never get them back but just because there's a law that says it is illegal doesn't stop the bike going missing Edited 29 Apr 07, 7:58 PM by fumblebone | ||

Will smoking in a club become a fetish and therefore be catered for? Would the police really bother to raid a club for smokers ignoring the bdsm? | ||

My club will be sticking very firmly to the ban. The owners are trying to buy another floor of the building that has an outdoor patio for the purpose. I have already watched one woman die because of smoking a few weeks ago and another friend has weeks left to live. You want to risk killing yourselves then fine but a lot of people are relieved at the ban, I for one won't be looking for a way to inflict dangerous substances on others that don't want to breath it in. Here's to having my kink gear smelling fresh when I get home. Miss Kitty
