I could have worded it better. It's the 'notoriously' part I really took exception to. We have the highest prison rate in Western Europe.

There are many reasons to oppose this legislation, I really don't think prison overcrowding is one of them!

Indeed there are - and every single one of them needs to be voiced in opposition to the legislation.

Key points to successful opposition to legislation have always been these:-

1. The legislation will be unworkable/ineffective.

2. The legislation will not achieve its stated aims.

3. The legislation will be costly.

4. The legislation will not significantly benefit society in general.

5. The legislation will lose votes.

Being 'unfair' has never been a primary argument.

The state of the prisons and the backlog of court cases speaks to items 3 and potentially 5 - particularly if it results in early release of other offenders who then commit further crime.

I endorse Emilys point:-

The other factor … which seems to have been completely forgotten in discussions here … if there is no intention to impose prison sentences, why have they suggested increasing the maximum penalty for 'publication, distribution and possession for gain committed under the 1959 and 1964 Obscene Publications Acts to five years imprisonment'? (section 2; paragraph 20 of the home office summary)

Publication, distribution and possession for gain means anyone who either sells hard copy images (magazines, photos, films, DVDs etc.) or who runs a website with adult content that requires a subscription fee. There is no mention of the content being of a violent nature, just that it contravenes the 1959 and 1964 Obscene Publications Acts.

Emily

This looks like a nasty little attempt to extend the OPA powers under cover of the violent porn furore - in the hope that no one will notice it - a common trick of governments.

This could be an opportunity to involve other groups who have an interest in more mainstream porn - as it seems to begin to impact upon vanillas as well.

Possibly linked to the fact that we have the highest number of crims :-D

The fact remains, that in the event of getting caught for a "soft" crime (which isn't terribly likely, apart from traffic offences!), the stats show that you are likely to get a caution or a suspended sentence.

To me it's not about putting people in prison (although it is a good point to make, and I made it to Baroness Scotland of Asthal http://www.homeoffice.gov.uk/about-us/organisati... it's about putting people on the DNA database.

Why else would a government introduce 1800 new offenses over a 10 year period without expanding prison capacity?

The Government could do well to see how other europeans run their prison/penal systems, I'm thinking of Holland, hardly anyone in prison - because they have a totally different attitude, they don't lock up people generally (or so I'm led to believe).

A kiss is just a kiss, but a whiplash lasts till morning.

Let's just hope there's still room for Tony Blair & Michael Levy.
